About these terms
World of Empires III is developed and published by Bruno Fargnoli, an independent developer established in Switzerland and publishing as NewSoftVision (“we”, “us”). These terms are an agreement between you and us. They apply to the game on Android and iOS, to its online services (player accounts, online parties, the servers that connect players and keep their games) and to this website.
By installing or playing the game, you accept these terms. If you do not accept them, please do not play. Our privacy policy explains how we handle your information.
Who can play
Anyone can play solo games. Online play is for players aged 13 or over. Where local law sets a higher age to accept these terms or the use of personal data, younger players need the permission of a parent or guardian, who accepts these terms for them.
Your account
To play online, you sign in with your Google Play Games or Apple Game Center profile. Your player account is tied to that profile.
- Keep your device and profile secure: what happens on your account is your responsibility.
- One account per player. Do not share, sell or transfer your account.
- Tell us straight away if you think someone else is using your account.
You can delete your account at any time, as described in the privacy policy.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to install the game on devices you own or control and to play it for your own enjoyment. The game is licensed to you, not sold. You may not:
- copy, modify, translate, decompile or reverse-engineer the game, except where the law expressly allows it;
- rent, sell, sublicense or redistribute the game or any part of it;
- use the game or its online services for commercial purposes without our written permission.
You are welcome to stream and share videos or screenshots of your games, as long as you do not suggest they are official.
Playing online
An online party is hosted by one player’s device, the device of the player who created it. The other players connect to it through our relay servers, or directly when everyone is on the same Wi-Fi. Up to ten rulers can share a party, humans and computer players together.
- Hosting. When you host, your device runs the party for everyone. If the host leaves or loses its connection, another player’s device takes over and the party goes on.
- Leaving and coming back. If you disconnect, the party pauses or the computer plays your civilization until you return. If the party has an idle timer and you miss three turns in a row, the computer stands in for you until you touch the game again.
- Surrender. If you surrender, the computer takes your civilization for the rest of the party. You cannot take it back.
- Saves. Online parties are saved on every player’s device and on our servers at the end of each turn, so they can be resumed. We do our best to keep them, but we cannot promise that a party will never be lost.
- Versions. Every player in a party needs the same version of the game. You may need to update the game to join or continue a party.
Fair play
Online parties are only fun when everyone plays by the same rules. You agree not to:
- cheat, or use bots, modified versions of the game or any tool that gives you an unfair advantage;
- exploit bugs on purpose; please report them to us instead;
- attack, overload or disrupt our servers, other players’ devices or their connections;
- harass, threaten or insult other players, including through in-game messages, or deliberately ruin their games;
- pretend to be someone else, including us;
- break the law while using the game.
Players talk to each other with a set of ready-made phrases. No free text can be sent, which keeps conversations friendly for everyone.
Purchases
If you pay for the game or for anything in it, you pay Google or Apple, and their terms apply to the payment, to refunds and to family sharing. Prices are shown in the store before you buy. Your rights as a consumer, such as a refund for a game that does not work, are not affected.
Our content and yours
The game, its name and logo, its art, music, texts, code and everything else in it belong to us or to those who licensed them to us, and are protected by law. These terms do not give you any right to them beyond your licence to play.
Your saved games and your player name are yours to use in the game. You give us permission to store, copy and send them as needed to run your parties and our online services. If you send us ideas or feedback, we may use them freely, without owing you anything.
Updates and availability
We keep improving the game. Updates may change, add or remove features or rebalance rules. Some updates may be required to keep playing online.
Online services depend on servers and networks, so they may sometimes be slow or unavailable, for example during maintenance. We may also end them one day. If we do, we will tell you in the game at least 30 days before. Solo games will keep working on your device.
Suspension and ending
You can stop playing and delete your account at any time.
If you seriously or repeatedly break these terms, we may remove you from parties, suspend online play for your account or close it. Unless the law or the safety of other players prevents it, we will tell you why and you can write to us to contest the decision. Solo play on your device is not affected.
Warranties and liability
We work hard to make the game good, but we provide it “as is”, without promising that it will be free of bugs, that it will always be available, or that it will suit your device or your purpose, as far as the law allows.
As far as the law allows, we are not liable for indirect or unforeseeable losses, such as lost data, lost progress or lost profits, or for problems caused by your device, your connection, other players or events outside our control.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, you keep all the rights that the law of your country gives you and that cannot be waived.
Google Play and the App Store
If you got the game from Google Play, the Google Play terms of service also apply.
If you got the game from Apple’s App Store, these terms are between you and us, not Apple, and:
- we alone, not Apple, are responsible for the game, its content, its maintenance and its support;
- if the game does not meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for it, if any; Apple has no other warranty obligation for the game;
- we, not Apple, are responsible for handling any claim about the game, including product liability claims, claims that it breaks the law, and claims that it infringes someone else’s rights;
- you confirm you are not in a country under a United States embargo and not on a United States list of restricted parties;
- you must also follow the terms of any third-party service you use with the game, such as your network provider;
- Apple and its subsidiaries benefit from these terms and may enforce them against you.
Law and disputes
These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods. The courts of Switzerland have jurisdiction.
If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of your own country, and you can bring a claim before the courts where you live.
If something goes wrong, please write to us first: most problems are solved faster that way.
Changes to these terms
We may update these terms as the game grows. The date at the top shows the latest version. If a change matters, we will tell you in the game before it takes effect. If you keep playing after that, the new terms apply; if you do not accept them, you can stop playing and delete your account.
